USER AGREEMENT

MARKETPLACE GUIDELINES

CROP MARKET — TERMS & CONDITIONS

Agreement. By posting an ad you agree to these Terms & Conditions in full. Crop Market is primarily an advertising platform — we connect growers, makers, and buyers. For most sales (local pickup and direct arrangements), we are not a party to the sale and do not process the payment between buyer and seller. We also offer an optional "Buy Now" online checkout on certain listings: when a buyer uses it, payment is processed through Stripe Connect, the seller is the merchant of record, and Crop Market currently charges no service commission — 0% (standard card‑processing fees are borne by the seller). Even then, Crop Market is not the seller and is not responsible for the goods, the transaction, or any communication between users. See the Payments section.

Permits, Licenses & Documents. You confirm that you personally hold every permit, license, registration, and document your product(s) require under federal, state, and local law (e.g., cottage‑food, produce, nursery, or seller's permits). Requirements vary by state, county, and product — you are solely responsible for determining and obtaining them. Crop Market provides general links for convenience only; this is not legal advice.

Prohibited Items. You will not list firearms, ammunition, weapons, drugs or controlled substances, alcohol, tobacco/vape, counterfeit goods, stolen property, hazardous materials, eggs, or any other item barred by our Prohibited Items Policy or by law. Prohibited listings are removed and may result in a ban.

Accuracy & Conduct. Your listing details, contact information, and location are truthful and current. You will deal honestly and lawfully with other users.

Liability. Crop Market and its operators are not liable for any loss, injury, dispute, or damages arising from a listing or a transaction between users. You use the platform at your own risk and indemnify Crop Market against claims arising from your listings or sales.

Enforcement. We may remove any listing and suspend or ban any user at our discretion. Advertising fees and any service commissions are non‑refundable when a listing or account is removed, suspended, or banned for a Terms violation. Continued use constitutes acceptance of these Terms as updated.

ACCEPTANCE OF TERMS
By accessing or using Crop Market ("the Platform," "we," "us," or "our") at mycropmarket.com, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not use the Platform.

ELIGIBILITY
You must be at least 18 years of age to create an account, post a listing, or make a purchase on Crop Market. By using the Platform, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement. Crop Market reserves the right to terminate any account found to belong to a minor.

PLATFORM DESCRIPTION
Crop Market is an online advertising platform that connects independent sellers of locally grown, farm‑fresh, cottage food, fresh cut flowers, and related agricultural products — as well as locally made or original apparel, artwork, stickers, and other handmade goods — with buyers in their community. The Platform provides tools for listing and advertising products and for buyers and sellers to connect with one another.

Crop Market is not the seller of any third‑party listing. Except for Crop Market's own branded products (see Crop Market Branded Products), Crop Market does not grow, harvest, manufacture, store, inspect, ship, or sell any products listed by third‑party sellers. Most sales between independent buyers and sellers are arranged and completed directly between those parties, off‑platform, and Crop Market does not process those payments. For listings where a seller enables the optional "Buy Now" checkout, payment is processed through Stripe Connect with the seller as the merchant of record; Crop Market only facilitates that checkout and charges the service commission described in the Payments section (the service commission is currently 0%). A listing/advertising fee a seller pays is for the advertisement only — never for the goods.

SELLER OBLIGATIONS
By listing a product on Crop Market, sellers agree to:
Provide accurate, complete, and non‑misleading product descriptions, photos, and pricing.
Only list items permitted under these Terms and applicable law (see Prohibited Items, In‑State Sales Only, and Agricultural & Food Compliance).
Hold all licenses, permits, certifications, and registrations required by local, state, and federal law for the sale of their products — including but not limited to California Cottage Food Operator permits, food handler/processor certificates, CDFA nursery licenses (for plants, seeds, and soil‑grown products), Federal Seed Act labeling, livestock health requirements, and any applicable county or CDFA registrations for the seller's specific category.
Deal honestly with buyers, honor the quantity and price listed at the time of sale, and promptly notify a buyer if an item becomes unavailable after the buyer has arranged to purchase it.
Arrange and complete all sales directly with the buyer — by local pickup or delivery, or, where the seller has enabled it, through the optional Buy Now checkout. Perishable, agricultural, and live goods — including fresh cut flowers — must be completed in person and within the same state (see In‑State Sales Only); finished non‑perishable goods (e.g., apparel, artwork, stickers) may be shipped as set out in the Stickers, Apparel & Artwork section.
For Buy Now sales, the seller remains solely responsible for fulfillment, packaging, shipping, refunds, chargebacks, and resolving any dispute with the buyer.
Crop Market does not guarantee the accuracy of any seller listing and is not responsible for seller non‑performance.

BUYER OBLIGATIONS
By contacting a seller or arranging a purchase through Crop Market, buyers agree to:
Provide accurate contact and pickup information.
Complete any agreed‑upon pickup within the timeframe communicated by the seller.
Pay the seller directly as arranged (or through the Buy Now checkout where offered), and not initiate fraudulent disputes for items properly received.
Treat sellers with respect during all communications and transactions.

USER CONDUCT & COMMUNITY STANDARDS
All users of Crop Market are expected to maintain a high standard of conduct. Every user must provide accurate and truthful information at all times. Any false representation or misleading information may result in the removal of listings and possible termination of the account. Sellers are expected to follow our community guidelines and to conduct their own transactions honestly and in good faith. Because transactions occur directly between buyers and sellers, each user is responsible for their own conduct during a transaction. Maintaining good standing is essential to fostering trust within our marketplace.

PROHIBITED ITEMS
The following may not be listed or sold on Crop Market under any circumstances:
Firearms, ammunition, weapons, explosives, or their components
Illegal drugs, controlled substances, prescription medications, or drug paraphernalia
Alcohol, tobacco, vaping/nicotine, or cannabis products of any kind
Eggs and egg products — Crop Market does not permit egg sales as a matter of platform policy, due to California egg‑handler registration, 45°F refrigeration, and Proposition 12 cage‑free requirements that the Platform cannot verify or enforce.
Wild‑harvested foods taken from protected, restricted, or private land without proper permits
Uninspected meat, poultry, or seafood (USDA/CDFA inspection required for non‑exempt sales)
Raw milk or raw milk products not compliant with applicable California law
Any food product requiring refrigeration or temperature‑controlled transport that cannot be safely handled at the point of sale
Counterfeit, stolen, recalled, or misrepresented items
Endangered or protected species, wildlife, or wildlife products (e.g., ivory)
Human remains or bodily fluids; hazardous, radioactive, or toxic materials
Government documents, identification, or law‑enforcement/government property
Any item the sale of which is unlawful in the buyer's or seller's jurisdiction
Permitted categories include locally grown produce and other Raw Agricultural Commodities, California Cottage Foods, fresh cut flowers, plants and seeds, farm animals/livestock, agricultural equipment, and locally made or original apparel, artwork, and stickers — each subject to the category‑specific rules below and in Appendix A. Crop Market reserves the right to remove any listing that, in our sole judgment, violates these restrictions or poses a risk to public health or safety. Repeated violations may result in permanent account suspension.

IN‑STATE SALES ONLY (PERISHABLE, AGRICULTURAL & LIVE GOODS)
Crop Market is strictly for in‑state transactions of food, plants, seeds, live animals, fresh cut flowers, and other agricultural goods. For those categories, sellers and buyers may only advertise, arrange, sell, transport, and complete transactions for goods that stay within the same state. You may not sell, ship, transport, or arrange the movement of any such item across state lines using the Platform. This in‑state restriction does not apply to finished, non‑perishable, non‑agricultural goods such as apparel, artwork, and stickers, which may be shipped as described in the Stickers, Apparel & Artwork section. You are solely responsible for ensuring your transaction complies with this rule and with the laws of your state.

AGRICULTURAL & FOOD COMPLIANCE
Sellers are solely responsible for complying with all applicable local, state, and federal agricultural, food‑safety, and labeling laws, including but not limited to:
California Cottage Food Law (Health & Safety Code §114365 et seq.) and CDPH‑approved product lists
California Department of Food & Agriculture (CDFA) regulations for Raw Agricultural Commodities
County agricultural commissioner requirements for produce sales and transport
USDA regulations for any products under federal oversight
All applicable food‑handling, labeling, and transport requirements in the seller's jurisdiction
Fresh cut flowers are treated as perishable agricultural goods: they are sold locally and in‑state, and a seller's permit may apply, but — because they are cut (not living, propagative material) — they do not require a CDFA nursery license (which applies to live plants and seeds).
The Cottage Foods & RAC Guide in Appendix A of these Terms explains which food items qualify as Raw Agricultural Commodities versus Cottage Foods and what each requires. Crop Market provides these summaries as a courtesy only. They do not constitute legal advice and do not relieve sellers of the obligation to verify compliance independently.

PLANTS & SEEDS
By listing plants or seeds, the seller represents and warrants that they:
Hold any nursery license required by law for the sale of plants, propagative material, or food grown in soil (in California, a CDFA License to Sell Nursery Stock — see Cal. Food & Ag. Code §6721 — subject to its small‑seller/seed‑only exemptions);
Comply with all seed‑labeling requirements, including the Federal Seed Act (germination, purity, noxious‑weed‑seed content, and shipper identity) and applicable state seed laws;
Will not list, sell, or move any federal or state noxious weed, invasive species, or quarantined plant in violation of the Plant Protection Act, the Federal Noxious Weed Act, or any state quarantine; and
Sell only within their own state.
The seller assumes full responsibility for the legality of every plant and seed they list.

FARM ANIMALS & LIVESTOCK
By listing farm animals or livestock, the seller represents and warrants that they:
Own the animals and have the legal right to sell them;
Are offering only healthy animals, accurately described, with no known disease, and will not misrepresent an animal's health, age, breed, or condition;
Will not list exotic, endangered, protected, or otherwise restricted species;
Comply with all applicable state and county animal‑health, welfare, and sale regulations; and
Complete all sales in person and within their own state.
Crop Market does not inspect, transport, or guarantee any animal. All risk and responsibility for the animal and the transaction rests with the buyer and seller.

AGRICULTURAL EQUIPMENT
Agricultural equipment, tools, and implements are listed and sold "as‑is," with no warranty of any kind from Crop Market. Buyers are responsible for inspecting equipment before purchase. Sellers are responsible for accurately describing the condition of equipment and for any safety, recall, or compliance obligations associated with what they sell.

PAYMENTS
Direct (off‑platform) sales. For sales completed directly between buyer and seller — local pickup, farm pickup, or seller‑arranged delivery — Crop Market does not collect, hold, retain, or process the payment. Buyers pay sellers directly (for example, in person at pickup), on terms the buyer and seller arrange between themselves. For these sales Crop Market is not a payment processor, escrow service, or party to the transaction and has no responsibility for it, and the seller keeps 100% of the sale.

Optional Buy Now checkout (online sales). Some listings offer an optional "Buy Now" online checkout. When a buyer uses it, payment is processed through Stripe Connect and the seller is the settlement merchant (merchant of record) for the charge — the funds settle to the seller's connected Stripe account, and the seller (not Crop Market) bears the standard Stripe card‑processing fees. Crop Market currently charges no service commission — zero percent (0%) — on these sales. Crop Market acts only as a limited payment facilitator for these transactions: it is not the seller of the goods, not an escrow, and is not responsible for fulfillment, product quality, shipping, refunds, chargebacks, or disputes — all of which are the seller's responsibility. Crop Market does not store payment‑card information; card data is handled by Stripe under Stripe's Terms and Privacy Policy. Crop Market reserves the right to introduce or change a service commission in the future; any such commission will be clearly disclosed at checkout before the buyer pays and is non‑refundable except at Crop Market's sole discretion.

Seller advertising fees. Sellers may pay a listing/advertising fee to Crop Market to post or promote a listing. This fee is processed by Stripe and is for the advertisement only — not for any goods. The fee and any applicable promotion are disclosed at the time of posting. Advertising fees are non‑refundable in the event of a Terms violation — including, without limitation, where a listing is removed or an account is suspended or banned for listing a prohibited item, misrepresentation, an out‑of‑state transaction of a restricted category, or any other breach of these Terms. Crop Market may, in its sole discretion, issue a refund in cases of genuine error, but is under no obligation to do so.

Crop Market's own products. Purchases of Crop Market branded products are sold by Crop Market directly and paid through Stripe on Crop Market's behalf.

CROP MARKET BRANDED PRODUCTS
In addition to operating as an advertising platform for independent sellers, Crop Market sells its own products directly on the Platform — for example, Crop Market apples (sold locally) and Crop Market branded stickers and collectibles (shipped). For these products:
The transaction is between the buyer and Crop Market directly.
Payment is processed through Stripe on behalf of Crop Market.
Crop Market is the seller of record and is responsible for fulfillment, returns, and any applicable consumer rights.
Crop Market branded products are clearly identified as such on their product pages, and are not subject to the cottage‑food or agricultural‑compliance requirements in the Agricultural & Food Compliance section.
Crop Market branded‑product sales and third‑party seller activity remain entirely separate. Crop Market does not hold third‑party sellers' goods, and for Buy Now sales acts only as a limited payment facilitator (the seller is the merchant of record).

STICKERS, APPAREL & ARTWORK (INDEPENDENT SELLERS)
This Section governs stickers, apparel, artwork, prints, and other custom or handmade designs advertised by independent sellers. Crop Market's own branded products are sold under the Crop Market Branded Products section.
a. Venue, not seller. For independent sticker, apparel, and artwork listings, Crop Market is an advertising venue only. We do not design, produce, sell, ship, or inspect independent sellers' stickers, apparel, or artwork. Each such listing is created and controlled by the individual seller, and any transaction is solely between the buyer and that seller. Where the seller enables Buy Now, Crop Market only facilitates the payment (seller as merchant of record) and currently charges no service commission (0%); the seller still ships and is responsible for the goods.
b. Seller owns the rights. By posting a sticker, apparel item, or artwork, the seller represents and warrants that they are the original creator of the design or artwork, or that they hold all rights, licenses, and permissions necessary to reproduce, advertise, and sell it.
c. No infringing or counterfeit material. Sellers may not post, advertise, or sell stickers, apparel, or artwork that reproduce, without authorization: trademarks, brand names, or logos; copyrighted characters, artwork, photographs, or text; the names, likenesses, or images of real people; counterfeit, knock‑off, or replica designs or branded goods; or any content that is unlawful, hateful, defamatory, obscene, or that violates any third party's intellectual‑property, privacy, or publicity rights.
d. Seller assumes all liability. The seller assumes full responsibility and liability for the designs and items they post and the products they sell, and agrees to indemnify, defend, and hold harmless Crop Market, its owners, and its affiliates from any claim, demand, loss, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to their listings, designs, or sales.
e. Right to remove. Crop Market may remove, disable, or refuse any sticker, apparel, or artwork listing at any time, with or without notice, for any reason. We are not obligated to monitor listings and assume no responsibility for any listing's content or accuracy.
f. Takedown requests. If you believe a listing infringes your copyright, trademark, or other rights, contact us at mycropmarket@gmail.com with: (a) a description of the work or mark you own; (b) the URL or identifying details of the listing; (c) your contact information; and (d) a good‑faith statement that the use is not authorized. We will review and may remove the listing, and we reserve the right to remove repeat infringers.
g. Shipping & in‑state rule. Stickers, apparel, artwork, and other finished, non‑perishable, non‑agricultural goods are not subject to the in‑state‑only restriction (which exists to protect food, plant, seed, flower, and livestock safety). These finished goods may be sold and shipped to buyers in other states where lawful. The seller is solely responsible for safe packaging, shipping, applicable sales tax, and compliance with the laws of both the origin and destination jurisdictions.
h. Compliance and taxes. Sellers are solely responsible for complying with all applicable laws governing the sale of their goods, including permit, licensing, sales‑tax, and consumer‑protection requirements. Requirements vary by state, county, and product. This section is general information, not legal advice.

ACCOUNT SUSPENSION & TERMINATION
Crop Market reserves the right to suspend, restrict, or permanently terminate any account, with or without prior notice, for reasons including but not limited to: violation of these Terms; listing or attempting to sell prohibited items; attempting an out‑of‑state transaction of a restricted category; fraudulent activity or false product descriptions; failure to honor an arranged sale without timely notice; threatening, harassing, or abusive conduct; or any activity that poses a risk to public health, safety, or the integrity of the Platform. Suspended users may appeal by contacting mycropmarket@gmail.com within 30 days. Crop Market's decision on appeal is final. Suspension, restriction, or termination for a Terms violation does not entitle the user to any refund of advertising fees, service commissions, or listing fees already paid, and any such amounts are forfeited.

INTELLECTUAL PROPERTY
All content on the Crop Market platform — including logos, design, branded‑product artwork, and proprietary software — is the property of Crop Market. Sellers retain ownership of the photos and content they upload but grant Crop Market a non‑exclusive, royalty‑free license to display that content on the Platform for the purpose of operating the marketplace.

DISCLAIMER OF WARRANTIES
The Platform is provided "as is" and "as available." Crop Market makes no warranties, express or implied, regarding the quality, safety, legality, or fitness for purpose of any product listed by third‑party sellers. Crop Market does not warrant that the Platform will be uninterrupted or error‑free.

LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Crop Market and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including but not limited to foodborne illness, spoilage, injury, failed transactions, or loss of income. Crop Market's total liability to any user for any claim arising out of or relating to these Terms shall not exceed the total fees and commissions paid by that user to Crop Market in the three (3) months preceding the claim.

GOVERNING LAW & DISPUTE RESOLUTION
These Terms are governed by the laws of the State of California, without regard to its conflict‑of‑law provisions. Any dispute arising from or related to these Terms or your use of the Platform shall be resolved in the state or federal courts located in Humboldt County, California, and you consent to the personal jurisdiction of those courts.

CHANGES TO THESE TERMS
Crop Market reserves the right to update these Terms at any time. Updated Terms will be posted to mycropmarket.com with a revised effective date. Continued use of the Platform after the effective date constitutes acceptance.
